Public violence
Article 141 of the Dutch Penal Code
If you are suspected of assault, this may appear on your summons in various forms. From simple assault to aggravated assault or public violence. In case of suspicion of assault, you are – in short – suspected of causing another person pain or injury. Assault is punishable under the law with a maximum prison sentence of three years or a fine of the fourth category. If the offense results in serious bodily harm, the guilty party is punished with a maximum prison sentence of four years or a fine of the fourth category. If the offense results in death, the guilty party is punished with a maximum prison sentence of six years or a fine of the fourth category. In the case of public violence, actions were taken jointly with others, and it is not entirely clear who exactly delivered which blow or kick, but this does not have to be established for a conviction. However, the defendant must have made a substantial contribution to the violence committed.
